How to Deal with Difficult Tenants?

Party animals, chronic late payers, animal lovers, and vandals – these are the most common types of nightmare tenants. These tenants commit a variety of violations such as not paying rent, damaging parts of your rental property, allowing pest infestations, and even committing criminal acts. Surprisingly, problems between property managers and bad tenants are actually common.

Once a bad tenant moves in your property, it is almost impossible to resolve the situation without taking a loss. Forcefully evicting tenants is not an option and can actually cost you an expensive fine. However, your local property manager usually handles these types of tenants by following a set of guidelines such as implementing a lease agreement, adherence to disclosure laws, and compliance with all local eviction laws.  These policies are actually effective solutions in clearing out a bad tenant.

Before the tenant moves in, property managers usually have already presented them with a Lease Agreement. This document usually contains policies on cleanliness, property maintenance, criminal activity, and late rental payment penalties. Property managers use a state-specific lease agreement since every state has a different landlord-tenant policy which dictates what a lease agreement can contain.

If issues do arise, trying talking with the tenant calmly about your concerns, many tenants will not realize their transgressions are that big of an issue and will correct their ways. Your local property manager also makes sure that he or she has complied with all of the disclosure laws in anticipating disputes with tenants. This is because some tenants, in response to the possibility of being evicted, would resort to legal action. Their lawyers would then determine whether the lease agreement is valid or not. Also, lawyers would check whether property managers have complied with all applicable landlord-tenant laws, which includes the necessary disclosures.  A good property manager complies with all disclosure laws.

Lastly, property managers are aware that every state has a different eviction policy in their landlord-tenant laws. In clearing a bad tenant out of the rental, property managers comply closely with these eviction laws. Sometimes real estate attorneys who specialize in evictions and eviction specialist themselves can also provide assistance in the eviction process.

As a final note, it is also important to realize that the occupancy of bad tenants can be prevented in the first place if an extensive tenant screening procedure was conducted. A lot of property managers would agree that screening tenants before signing contracts is the most important step in protecting against any type of property damage.  Good property managers will conduct a comprehensive tenant screening process to prevent bad tenants from occupying your rental property.
